Who we are

Equimotional is the trading name of Charlotte Vicary, a sole trader based in the United Kingdom ("Equimotional", "we", "us"). When you buy from or use this website you are contracting with Charlotte Vicary trading as Equimotional.

Equimotional provides horse-themed, project-based home education resources, including downloadable projects, memberships, colouring pages, certificates and related digital content. Our resources are designed to complement your family's chosen approach to education; they are not a complete UK curriculum.

What we sell

Everything Equimotional sells is digital content, delivered instantly to your online parent account as downloadable PDF files. There are no physical goods, and nothing is posted or shipped to you.

We do not provide tutoring, lessons, coaching, therapy, riding, animal contact or any other in-person or live service, and we do not arrange any contact with children. Accounts are held and paid for by an adult (18 or over), who chooses how and when to use the materials with their own children.

Accepting these terms

By continuing to use this website, creating an account or making a purchase, you agree to these terms. If you do not agree, please do not use the service. You must be an adult (18 or over) to create an account or make a purchase; children use the resources under the supervision of their parent or carer, and children never hold their own accounts.

Your account

You are responsible for keeping your sign-in details confidential and for all activity under your account. Please provide accurate information when you register and keep it up to date.

Using the service fairly

You must not misuse the service. That includes:

  • using it for anything unlawful, fraudulent or deceptive;
  • infringing anyone's intellectual property rights;
  • sending spam or uploading malware;
  • probing, scanning, scraping or otherwise interfering with the security or operation of the service;
  • reselling, redistributing or publicly sharing purchased projects, downloads or your account access.

We grant you a limited, non-exclusive, non-transferable licence to use the resources you have purchased or unlocked for your own family's home education. You may print our downloads for your own children, but you may not sell, share or republish them.

Our content and intellectual property

The service, including all projects, illustrations, branding, text and downloads, belongs to Equimotional. Nothing in these terms transfers any ownership to you.

Payments, subscriptions and our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, renewals, cancellations and refunds are handled under Paddle's Buyer Terms. Memberships renew at the frequency you chose (weekly, fortnightly or monthly) until cancelled, and you can cancel at any time from your account — anything you have already unlocked stays yours. One-off project purchases are permanent and do not renew.

Availability of the service

We work hard to keep the service available and accurate, but we cannot guarantee it will always be uninterrupted or error-free. To the fullest extent permitted by law, the service is provided "as is" and we exclude all implied warranties, including merchantability and fitness for a particular purpose.

Suspension and ending accounts

We may suspend or end access to the service if you materially breach these terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously breach these terms. If your account ends, purchases and downloads you have legitimately made remain governed by these terms, and we may delete account data that is no longer needed, in line with our privacy notice.

Liability

Nothing in these terms limits our liability for fraud, or for death or personal injury caused by our negligence, or anything else that cannot be limited by law. Subject to that, we are not liable for indirect or consequential losses (such as loss of profits, data or goodwill), and our total liability to you is limited to the amounts you paid us in the 12 months before the claim arose.

General

You may not transfer your account or these terms to anyone else without our agreement. We may transfer our obligations as part of a merger or sale of the business. We are not responsible for delays or failures caused by events beyond our reasonable control. These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
